For expats and international enterprises or organizations, in case there are contract disputes and other prop- erty rights disputes within and outside China, including but not limited to disputes arising from foreign-related economic activities, transportation and maritime disputes it shall be put to arbitration. Disputes and administrative disputes rising from identity, such as marriage, adoption, guardianship, bringing up of children, and inheritance, shall not be put to arbitration and shall be handled by other departments in accordance with the law. In settling disputes through arbitration, an agreement to engage in arbitration shall first of all be reached by parties concerned upon free will. The arbitration award is final. After the award is given, the arbitration commission or the people’s court shall not accept the re-application of the lawsuit concerning the same dispute by any of the parties concerned. The compulsory execution of the effective arbitration award or mediation agreement could be carried out between member states of the New York Convention after application.
