APPLICATION FOR PERMANENT RESIDENCE

02 Application Conditions
Expats who have made outstanding contributions to China’s economic and social development or meet other conditions for permanent residence in China may apply for permanent residence.


Applicants who apply for permanent residence in China must abide by Chinese laws, be in good health, have a clean criminal record, and meet one of the following conditions:
a.Directly investing in China, maintaining stable invest- ment for three consecutive years, and having a good tax record.
b.Holding the position of deputy general manager, deputy factory director or above, or holding the associate senior titles or above such as associate professor, associate researcher or above, enjoying the equivalent salary in China for at least four consecutive years, residing in China for a cumulative period of no less than three years within the past four years, and having a good tax record;
c.Making significant and outstanding contributions to Chi- na or meeting the special needs of the country;
d.Spouse and unmarried children under 18 of the appli-
cant referred to in the first, second, and third items;
e.Spouse of Chinese citizens or expats who have obtained permanent residence in China. The marriage must have lasted for five years, with continuous residence in China for five years, residing in China for no less than nine months each year, and having a stable livelihood and residence;
f.Unmarried children under 18 dependent on their parents.
g.Those who have no direct relatives abroad, are de- pendent on immediate relatives within China, are aged 60 or above, have continuously resided in China for five years, reside in China for no less than nine months each year, and have a stable livelihood and residence.
03 Application Materials
In addition to a valid foreign passport, a health certificate, a clean criminal record at home or abroad, three two-inch-sized photographs, the completion of three application forms, and any other certificates deemed necessary by the public security authorities, expats applying for permanent residence in China are also required to submit the following documents (three copies).
Investors
a.A copy of the business license of the enterprise legal person;
b.A copy of the approval certificate of foreign-invested enterprise;
c.Certification of annual report of enterprise announcement;
d.Confirmation of foreign investment project;
e.A copy of the capital verification report;
f.Enterprises within the scope of incentive foreign investment policy are also required to provide a confirmation letter of foreign-invested projects incented by the State or a copy of the certificate issued by the provincial competent authority confirming that the enterprise is a foreign-invested enterprise incented by the State for development, and a copy of the certification of individual tax payment.
Employed Personnel
a.Copy of the employment certification;
b.Copy of the expat’s work permit in China;
c.Copy of the enterprise registration certification;
d.Certification of annual report of enterprise announcement;
e.Copy of the approval certificate for the foreign-invested enterprise;
f.Copy of the project certification or confirmation;
g.Copy of the personal tax payment certification.
Special Personnel
a.Copy of the recommendation letter;
b.Copy of relevant awards and achievement certification.
Spouses and unmarried children under 18 of investors, employed personnel and special personnel
a.Copy of the marriage certificate, birth certificate, or certification of parent-child relationship;
b.Copy of the expat's permanent residence ID for investors, employed personnel, and special personnel.
Family Reunion Personnel
a.Copy of the marriage certificate;
b.Copy of the spouse’s identification document;
c.Copy of the certification of tenancy or housing ownership certificate;
d.Copy of the certification of financial support.
Parent-child Reunion Personnel
a.Copy of the birth certificate or certification of parent-child relationship;
b.A copy of the certificate of identity of one of the Chinese parents, or a copy of the valid passport and expat’s permanent residence ID card of one of the foreign parents;
c.If the parents are divorced, a copy of the certification from the sponsor indicating their guardianship responsibility for the applicant should be provided.
Relatives-Joining-Family Personnel
a.A copy of the certification that the applicant has no immediate family members abroad;
b.A copy of the certification of kinship in China;
c.A copy of the certificate of permanent household registration and resident’s identity card of Chinese sponsor; or a copy of the valid passport and expat’s permanent residence ID card of the foreign sponsor;
d.A copy of the certification of tenancy or housing ownership certificate;
e.A copy of the certification of financial support.
The above materials involving marriage certificate, birth certificate, kinship certifications and certification of change of name and other information issued by the competent authorities or notary publics of foreign countries shall be authenticated by the Chinese Embassy and Consulate in that country, and the relevant foreign language certifications shall be translated into Chinese.
04 Basic Procedures and Application Methods
a. Application:

Expats seeking permanent residence in China can submit applications in person or through their parents on behalf of unmarried children under 18 or authorized proxy. Applications need to be submitted to the municipal-level public security authorities at the city where the main investment or long-term residence is located, or to the public security sub-bureau and county bureau in directly-administered municipalities. If the application is made by the entrusted person, a power of attorney issued by the applicant and notarised by a notary public shall be submitted. The power of attorney issued by the applicant abroad must be certified by the Chinese Embassy and Consulate in that country.

b. Acceptance, Review and Decision:

The acceptance authority is required to complete the investigation within three months as of the date of acceptance and submit eligible cases to the examination authority. The inspection authority is then tasked with completing the review within two months and submitting eligible cases to the National Immigration Administration for approval. If the applicant does not meet the criteria, both the acceptance and inspection authorities must make a decision denying approval on behalf of the National Immigration Administration within the specified timeframe. Expats approved for permanent residence in China will be issued a Permanent Residence ID Card by the National Immigration Administration. For those applying for renewal/replacement or reissue of certificates, the accepting authority, after completing the investigation, will submit eligible cases to the examination authority, which will, in turn, forward them to the National Immigration Administration for card production after completing the review.

05 Renewal/Replacement or Reissue of Permanent Residence ID Cards for Expats

If a expat’s permanent residence ID card expires, or if its contents are changed, are damaged or lost, the holder shall apply to the public security authorities of the people’s government at the municipal level of city in which he or she permanently resides, or to the public security sub-bureau or county bureau of the municipality directly under the central government, for the replacement/renewal or reissue of the card. The public security authority will conduct a review, and if the card holder is deemed to have not lost their eligibility for permanent residence in China, the replacement/renewal or reissue will be completed within one month. Application documents are as follows:


a.Fill in the Application Form for Replacement/Renewal or Reissue of Expat’s Permanent Residence ID Card, and provide three recent two-inch-sized photos.
b.For those applying for renewal due to the expiration of the ID card, the application should be submitted within one month ahead of the expiry date. The applicants need to provide the original of valid passport and expat permanent residence ID card, as well as three photocopies of the original.
c.For those applying for replacement due to content modification, the application should be submitted within one month as of the date of change, and the original and three copies of valid passport and expat permanent residence ID card and relevant certification before and after the change of information shall be provided. Certifications issued by foreign countries shall be certified by the Chinese Embassy (Consulate) abroad.
d.For those applying for renewal due to damage of the ID card, they need to provide the orig- inal and three copies of their valid passport and expat permanent residence ID card.
e.For those applying for reissue due to loss of the ID card, they needs to provide the valid passport and three copies of it, three copies of the original permanent residence certificate, and submit a certification of loss issued by the public security authorities of the place where the loss was reported or three copies of the statement of loss written and signed by themselves.
f.If the original expat’s permanent residence ID card was processed by the public security authorities in another province or city, they also need to provide relevant certification of permanent residence in Shijiazhuang, including the Temporary Accommodation Registration Form for Expats, housing ownership certificate or employment (study) certification of the applicant (or his/ her spouse).

g.Other certifications deemed necessary by the public security authorities.
