EXPATS APPLYING FOR NOTARIZATION SERVICES

1.Scope of Application

The concerned parties of notarization refer to expats, international enterprises or organizations.



2.Documentations on Subject Qualification of Expats
If the applicant is a natural person, proof of identity (passport or other valid identity documents issued by the issuing country) shall be provided. If the applicant is a legal person or other organization, the submitted qualification

proof documentations must be notarized by the notary public of the country where the applicant is from and authenticated by the Chinese Embassy or Consulate in that country, or undergo the certification procedures stipulated in the relevant treaties between the People’s Republic of China and the country where the applicant is from. If notarization and authentication procedures are required, and the foreign party’s country does not have diplomatic relations with the People’s Republic of China, it can be notarized by the notary public of that country, authenticated by the embassy or consulate of a third country with diplomatic relations with the People’s Republic of China in that country, and then transferred to the embassy or consulate of that third country in the People’s Republic of China for authentication.


3.Providing Documents Related to Notarization Matters
Foreign parties applying for notarization shall provide corresponding proof documentations based on the notarized matters applied for. If the submitted proof documentations are in foreign languages, they shall be translated into Chinese language. The translation can be done by the notary public or by a commissioned professional translation company. The translation costs shall be borne by the parties themselves.
Documents Required for Entrusting An Agent to Apply for NotarizationIf a expat, international enterprises or organization applies for notarization and needs to entrust an agent to handle it on its behalf, and the notarized matters involve property disposal, the letter of authorization issued by the foreign natural person outside China shall handle the relevant notarization, authentication procedures or other proof procedures. For agents who have not completed relevant procedures, the notary public will not recognize their agency qualifications. The letter of authorization signed by a foreign natural person in the presence of notary personnel is not required notarization, authentication, or other proof procedures. The letter of authorization signed by a foreign natural person in China shall be notarized by a notary public in China to prove the identity of the foreign natural person and that the letter of authorization was signed in China, and no notarization, authentication, or other proof procedures will be required.
The legal representative or person in charge of a foreign enterprise or organization who issues a letter of authorization on behalf of the enterprise or organization outside of China shall go through relevant notarization or authentication procedures or other proof procedures; Agents who have not completed relevant procedures will not be recognized for their agency qualifications. The letter of authorization signed by the legal representative or person in charge of a international enterprises or organization in China on behalf of the enterprise or organization shall be notarized by a notary public in China to prove that the letter of authorization was signed in China. If the legal representative or person in charge submits to the notary public a certificate issued by a international enterprises or organization, proving his right to sign the letter of authorization, and which has completed notarization, authentication, or other certification procedures, no notarization, authentication, or other certification procedures of the letter of authorization will be required.
If the expats entrust a lawyer to handle notarization, the lawyer must be Chinese.

4.Notary public available for expats’ notary services

If an expat is in China, it may be accepted by a notary public located in their place of residence, place of conduct, or place of occurrence.

International enterprises or organizations that have a permanent representative office within the territory of the People’s Republic of China may apply to the notary public in the place where the representative office is located, the place of conduct, or the place where the fact occurred for handling. If there is no permanent representative office, they may apply to the notary public in the place of conduct or the place where the fact occurred for handling.
