I. Who needs to participate in the insurance?
A: Foreigners lawfully employed by enterprises,institutions,social organizations, private non-enterprise units,foundations, law firms,accounting firms and other organizations registered in China shall participate in basic pension insurance,basic medical insurance, work injury insurance,unemployment insurance and maternity insurance, and the employer and the employee shall pay social insurance premiums as required.
After entering into an employment contract with an overseas employer,the foreigner who is assigned to work in a branch or representative office registered in China shall also participate in social insurance according to law.


II.How do employers apply insurance for foreign employees?
A:After the foreigner is employed by the employer in Nanjing,the employer should bring his or her valid passport and other valid identity documents such as Foreigner's Work Permit in China or Permanent Residence Permit to apply for social insurance registration at the social insurance agency where the employer is registered. If there is a mutual exemption agreement, the employer must provide the original and a copy of the mutual exemption agreement.


III.How to determine the contribution base?
A:1.All types of insurances under the social insurance framework use the same contribution base.Anew employee's insurance will be based on his/her very first monthly salary from the second year onwards, the monthly contribution base for the current settlement year(January to December) wil be declared by dividing the total salary income of the employee in the previous natural year by the actual number of months of salary paid. The contribution base declared by the employer should be known to the employee either through the latter's confirmation or public announcement.
2.According to the National Bureau of statistics,the total wage income of employees include: hourly wages,piecework wages, bonuses,allowances and subsidies, such as overtime wages, wage income paid under special circumstances and so on.
3.The city human resources and social security department announces the upper and lower limits of the contribution base every year. If the employee's salary income exceeds the upper limit,it wil not be included in the individual contribution base;if the employee's salary income is lower than the lower limit,the employee's individual contribution base wil be determined according to the lower limit. The employer shall declare its contribution base according to the actual salary income of the employees.If the declared contribution base is higher than the upper limit or lower than the lower limit,it wil be adjusted by the agency after the upper and lower limit of the contribution base is determined.


IV.How to transfer and continue the social insurance relationship?
A: If foreigners leave Jiangsu Province for cross-region employment after suspending their pension insurance relationship,they can apply directly to the social insurance agency in the place of transfer or apply by logging on to the National Social Insurance Public Service Platform(http:isi.12333.gov.cn/), "12333 app" and Alipay.When foreigners apply for the transfer of basic pension insurance relationship,they are not restricted by the regulations of men under 50 years old and women under 40 years old.


V. How do foreigners enjoy social insurance benefits?
A:Foreigners who participate in social insurance can enjoy social insurance benefits if they meet the requirements. Foreigners who leave China before reaching the required pension age, can retain their personal social insurance account,and if they come to China for employment again,the number of years of contributions will be calculated in an accumulative manner; if they apply in writing to terminate the social insurance relationship, they can also obtain the amount stored in their personal social insurance account to themselves in a lump sum.
