New Law: Direct Residence Permit Application Without Work Permit

The regulations include several provisions encouraging foreign science and technology professionals to participate in innovation efforts in Guangdong.
The regulations stipulate that, except in cases involving national security, foreign science and technology professionals can lead applications and implementation of government-funded research projects and participate in strategic research and project management.

The regulations also specify that universities, research institutions, and other scientific organizations can hire foreign science and technology professionals based on their development needs. Relevant departments at the municipal level or higher, such as public security, human resources, social security, and science and technology, are required to facilitate the entry, permanent residence, work permits, talent visas, and invitation letters for foreign experts and their families. Additionally, they must optimize the criteria for recognizing foreign talent in high-demand fields.
The regulations state that foreign professionals holding talent visas can apply directly for work-related residence permits in the Guangdong-Hong Kong-Macao Greater Bay Area without first obtaining a work permit, following national guidelines.
Furthermore, the regulations allow full-time foreign science and technology professionals working in Guangdong to engage in part-time work. With the consent of their primary employer and the prospective part-time employer, and after filing with relevant municipal government departments, they can take on part-time jobs within the province.
The regulations will come into effect on October 1, 2024.
